Decision to Apply for Leave to Appeal
The Queenstown Lakes District Council will apply to the High Court for leave to appeal the High Court Hawthorn Estate subdivision decision.
In December last year the High Court upheld Hawthorn Estates ability to subdivide into 32 lots the 34ha area known as 'the Triangle', bounded by the Lower Shotover, Domain and Speargrass Flat Roads.
In a public excluded item today, the full Council voted to apply for leave to appeal and await a similar case being taken by the Selwyn District Council.
Councillors Gillian Macleod, Kathy Neal and Wayne McKeague voted against the motion
"There are a number of similarities between the two cases. We will make a final decision whether or not to file the appeal, pending the outcome of that Council's appeal," QLDC Mayor Clive Geddes said.
